Evaluation ordered for man charged with robbing delivery driver at gunpoint

A delivery guy for a Norfolk Street pizza place whose owner was murdered in 2007 came close to buying it himself on Dec. 10 when he tried to reason with a man on Capen Street who pulled a gun on him, the Suffolk County District Attorney's office reports.

Dorchester District Court Judge Michael Coyne today ordered Jose Martinez, 20, to Taunton State Hospital for 20 days of evaluation, after a court clinician said Martinez was not competent to participate in his own defense, the DA's office says. Martinez was being arraigned on charges of of armed robbery, unlawful possession of a firearm and assault with a dangerous weapon for the incident at 31 Capen St.

According to prosecutors, the driver for Stalex Pizza on Norfolk Street arrived at that address around 10 p.m. and was met at the door by a gun-toting Martinez, who demanded "whatever you have." The DA's office provided an account of what happened next:

" 'Let's talk,' the driver said.

" 'I don't want to talk,' Martinez allegedly said, racking the slide on a silver-colored semiautomatic handgun. The driver at that point handed over a pizza and two orders of chicken wings."

By the time police arrived, Martinez was gone. However, the driver spotted him on Tuesday and followed him to a Norfolk Street residents before notifying police.

Stalex Pizza owner Mumin Manavoglu died in 2007 from a robbery: He was robbed of $60 in his pizza place, then ran after the robber, who shot him in the head. Gary Johnson of Roxbury was sent away for life without parole following his conviction in 2009 for the murder.
