The Boston Police Department reports arresting a man and a teen at a luxury apartment building in Wellesley Thursday on charges they shot an Abbott Street resident during a home invasion early on Jan. 25.

Boston Police say the man, 45, had invited a lady friend over for the night. She arrived with a companion, who left, allegedly to get food, then returned with no food – but with two men, one armed with a handgun, the other with a shotgun – police say: “The suspect armed with the handgun discharged the firearm, striking the victim. Following the shooting, the victim was sprayed with an unknown substance by one of the female suspects. All four suspects fled the apartment shortly afterward.”

Police did not identify the location of the home invasion. However, not long after the incident, Stanley Staco, who follows Boston Police radio traffic, reported it had happened on Abbot Street, near Harvard Street.

Police say:

“Detectives subsequently identified a vehicle observed leaving the area after the shooting, as well as the vehicle’s owner and an individual associated with it. A search warrant executed at the victim’s residence resulted in the recovery of ballistic evidence.

“Over the following month, detectives utilized a range of investigative techniques to identify the occupants of the vehicle, track its movements, and determine the address and apartment the suspects entered after the incident.

“As a result of the investigation, B-3 detectives obtained multiple search warrants and two arrest warrants. A coordinated joint-agency operation was then conducted in Wellesley to take two suspects into custody.

Around 6 a.m. Thursday,  District B-3 detectives, the B-3 anti-crime unit, a SWAT team and Wellesley officers entered an apartment at 41 William St.  in Wellesley – the Nines of Wellesley, which promises residents “a lifestyle of comfort and exclusivity,”  with studios that can go for more than $7,300 a month. Arrested: Justin Martin, 31, and Jahde Nitschke, 18.

Martin was charged with home invasion, assault and battery by discharging a firearm, assault and battery with a dangerous weapon, unlawful possession of a firearm, second offense, unlawful possession of a loaded firearm, second offense and unlawful possession of ammunition, while Nitschke was charged with home invasion and assault and battery with a dangerous weapon – pepper spray.

At their arraignments in Dorchester Municipal Court Thursday, both were ordered held without bail at least until dangerousness hearings on Monday, according to court records.

Police add: “A subsequent search of the apartment resulted in the seizure of cell phones, clothing believed to have been worn during the home invasion, and a Smith & Wesson M&P Shield .40 caliber firearm containing eight rounds of ammunition. Detectives also towed a vehicle located outside the residence for further investigation.”
